Legal aspects of protection and commercialization of intellectual property specially at public universities

Academic freedom, specially freedom of research results dissemination is fundamental principle of high education and research system. On the other hand effective cooperation between science and business requires some restraints. The most discursive problems in this field are: publication delay clauses in sponsored research contracts, need for protection of academic know-how, priority of publication, using exclusive licensing contracts. The other issue which will be also covered in the exposition and tend to be subject of discussion is the problem of ownership of research results in particular professors privilege recently postulated in Poland, abandoned in Germany, non-existing in US law.
